Privacy statement for the protection of your personal data

Introduction
 

This processing activities is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter the “GDPR”) and Regulation (EU) 2018/1725 of the European Parliament and of the Council, of 23 October 2018, on the protection of natural persons with regard to the processing of personal data by the Union institutions, bodies, offices and agencies and on the free movement of such data (repealing Regulation (EC) No 45/2001).

Why and how do we process your personal data?

The Media Board processes your personal data to obtain your views on the Statement of Purpose, Multiannual Strategy and 2025 Work Programme drafts, before their adoption. 

The questions are posted on the website and stakeholders may provide their answers to the questions on which they are consulted through a reply to a given functional mailbox of the Secretariat of the Media Board or through the use of the Eu survey2. People may decide to participate after they have been contacted by any of the Board members or decide to participate voluntarily of their own motion. The analysis of the replies will be conducted manually or, for the EU survey, with the support of its features by the Board members. The analysis is intended to allow to identify certain general trends and indications on the stakeholders views on the different draft documents on which they are consulted. The feedback will be reflected in a short report and in the final documents to be adopted by the Media Board.  

Your personal data will not be used for an automated decision-making including profiling.

On what legal ground(s) do we process your personal data?

Your personal data are processed in line with Article 6(1)(e) GDPRprocessing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller”.  The underlying Union law is Article 13 of Regulation (EU) 2024/1083 of the European Parliament and of the Council of 11 April 2024 establishing a common framework for media services in the internal market and amending Directive 2010/13/EU (European Media Freedom Act). of Regulation (EU) 2018/1725). 

Which personal data do we collect and further process?

The Media Board will process the following personal data: 

  • name and surname,
  • profession, 
  • country of residence, 
  • e-mail address of the respondent,
  • the name of a self-employed individual (natural persons) on whose behalf the respondent is contributing,
  • personal data related to the physical, economic, cultural, or social identity of the respondent, insofar as they are not falling under Article 10 of the GDPR,
  • personal data included in the response or contribution to the targeted consultation activity, including (personal) opinions (if the targeted consultation at hand requires so),

Furthermore, you may spontaneously provide other, non-requested personal data in the context of your reply to the consultation on the Statement of Purpose (‘SoP’), Multiannual Strategy (‘MaS’) and 2025 Work Programme (‘WP’) drafts.

How long do we keep your personal data?

The Media Board will retain your personal data for 2 years, after which personal data will be deleted.

How do we protect and safeguard your personal data?

All personal data in electronic format (e-mails, documents, databases, uploaded batches of data, etc.) are stored on the servers of the Commission, pursuant to Commission Decision (EU, Euratom) 2017/46, of 10 January 2017, on the security of communication and information systems in the Commission, and on the servers of the joint-controllers.

In order to protect your personal data, the joint controllers and the Commission have put in place a number of technical and organisational measures. Technical measures include appropriate actions to address online security, risk of data loss, alteration of data or unauthorised access, taking into consideration the risk presented by the processing and the nature of the personal data being processed. Organisational measures include restricting access to the personal data solely to authorised persons with a legitimate need to know for the purposes of this processing operation.

Who has access to your personal data and to whom is it disclosed?

Access to your personal data is provided to the joint-controllers for this processing activity and to the Commission staff (as processor), according to the “need-to-know” principle. 

What are your rights and how can you exercise them?   

You have specific rights as a ‘data subject’ under Chapter III (Articles 12 to 23) GDPR, in particular the right to access your personal data and to rectify them in case your personal data are inaccurate or incomplete. Under certain conditions, you have the right to erase your personal data, to restrict the processing of your personal data, to object to the processing and the right to data portability. 

You also have the right to object to the processing of your personal data which is lawfully carried out pursuant to Article 6(1)(e) GDPR, on grounds relating to your particular situation.

You can exercise your rights by contacting the joint-controllers and, in case of conflict, the national data protection authorities.
